Résumé

This scientific article examines the structural, legal, and operational mechanisms involved in reducing the caseload burden on economic courts in the Republic of Uzbekistan through the integration and promotion of commercial arbitration. Amid rapid economic liberalization and increasing cross-border trade, the judicial system of Uzbekistan—specifically its economic courts—faces a growing volume of business disputes. This study evaluates the legal reforms implemented over the past decade, focusing on the Law of the Republic of Uzbekistan No. ZRU-674 "On International Commercial Arbitration" and the operational milestones of the Tashkent International Arbitration Centre (TIAC). Utilizing a comparative-legal and empirical approach, the paper assesses the current efficiency of economic courts, identifies procedural bottlenecks, and analyzes how commercial arbitration and domestic arbitration courts (hakamlik sudlari) serve as vital mechanisms to offload civil commercial disputes. The findings highlight key legal improvements, including the adoption of UNCITRAL-aligned standards and amendments to the Economic Procedural Code. The paper concludes with actionable recommendations to strengthen party autonomy, improve court-arbitration interaction, and expand specialized ADR awareness among business entities..
