This thesis provides a systematic analysis of the existing legal and practical problems in the process of assigning preferential pensions, which is a crucial element in realizing citizens’ rights to social security. By studying the legal nature of social protection mechanisms for employees engaged in jobs with hazardous and arduous working conditions, gaps in legislation, procedural barriers in the distribution of the burden of proof, and the disproportion of financial burdens are revealed. As a result of the research, specific legal proposals have been developed to improve current legislation based on international standards and modern economic requirements.
