Abstract

In the context of accelerating transnational labor migration, ensuring the legal safety of citizens abroad has transcended the traditional capacities of unilateral state mechanisms. This article explores the international legal frameworks governing the diplomatic and consular protection of labor migrants, with a specific focus on developing an integrated regional model for Central Asian states (Uzbekistan, Tajikistan, Kyrgyzstan, Kazakhstan, and Turkmenistan). Utilizing comparative law and institutional analysis methodologies, the study evaluates the established supranational standards within the European Union—specifically examining Council Directives 2015/637 and 2019/997—which guarantee consular assistance to unrepresented citizens in third countries. The research contrasts these mechanisms with the current national legislation of Central Asian states, noting that their current Consular Charters restrict protective frameworks strictly to existing institutional geographies, thereby leaving migrants vulnerable in newly emerging labor markets. To address these institutional gaps, the author proposes a conceptual "Regional Integrated Consular Protection Model" founded on Article 46 of the 1963 Vienna Convention on Consular Relations. The paper outlines the structural parameters for a multilateral Framework Convention among Central Asian states, the unifications required for a joint Emergency Travel Document, and a trans-border clearing system for financial compensation, aiming to elevate regional integration and secure transnational labor safety without compromising state sovereignty..
